In First of its Kind Chhattisgarh RERA Hands over Private Housing to State Board

In first of its kind Chhattisgarh Real Estate Authority (RERA) has passed an order to hand over the Nardaha-based private Housing Project City of Valencia to the Chhattisgarh Housing Board in the interest of plot holders in this project.

The RERA took this action when basic facilities like road, electricity, water and sewerage promised by the promoter Aftab Siddiqui in the brochure were not developed in the project even after passing of five years.

The promotor had brought the housing project of 1072 plots in Nardaha and promised all basic facilities but even after five years of starting the project, no development work was done in the said project.

After the complaint by the plot holders, RERA decided to hand over the said project to the Chhattisgarh Housing Board which will now take possession of this project and hand over the action plan for the development of necessary basic facilities to RERA withing two months. 

RERA Vivek Dhand said that 130 plot holders of the project submitted a complaint before the RERA in 2019 alleging non-completion of the development work. During the hearing of the of these complaints it came to light that the promoter of this project has obtained development permission in the year 2010 to construct a well-equipped residential colony of total 1072 plots in this project and a brochure of the same was released. 

As many as 691 plots in the project were sold and Rs 41 crore was obtained from this. This project was completed by 2015 but even after 6 years of completion no development work was done. The project was not even registered under RERA by the promotor as per rules. 

In compliance of the Supreme Court order in this regard RERA handed over the project to the housing board of Chhattisgarh said the RERA President. The Housing Board will also register this project in RERA as per rules. Raipur district collector has been asked to take necessary action for the transfer of this project.

Chhattisgarh Housing Board will have the right to develop the project and sell the mortgaged and unsold plots after the project is transferred. The Chhattisgarh Housing Board will also have the right to execute the registered sale deed of the plots and receive the sale consideration. 

Chhattisgarh Housing Board will transfer the project to the residential society for the purpose of maintenance after completing the development work of the project in the prescribed time period and as per the estimate and work plan.
