Kerala HC orders Govt to Make NOC mandatory across state

The Kerala high court on Thursday asked the state government to make no-objection certificate (NOC) from village office mandatory for issuing building permit for construction on assigned lands across the state. Justice A Muhamed Mustaque ordered that the secretary of local self-government department should issue an order making NOC mandatory so as to prevent commercial constructions on assigned lands. The court was considering a petition (WP-C No. 17983/2019) filed by Laly George of Bison Valley in Idukki. On September 25 last year, the local self-government department had issued an order requiring such NOC from village office mandatory for construction on assigned lands in Idukki. This was following an order issued by the high court on August 22 last year. The court had then asked the government to implement the NOC rule within two months and also to amend building rules so as to make the NOC mandatory in Idukki within two weeks. It was also pointed out by the court that different legislations govern the land in the state, and local bodies often grant building permits overlooking the land laws and then direct for demolition after the construction is complete.
