Noida Authority Delays Land Possession To ATS Homes For Sports City

The developer constructing a cricket stadium and the Sports City in Sector 152 has informed the Allahabad high court that the Noida Authority has not complied with its April 2023 order to allot 25 acres of land earmarked for the project. Subsequently, the court has directed additional advocate general Manish Goel to submit a response on behalf of the govt’s by the next date of hearing on April 3.

In 2022, ATS Homes had filed a petition claiming the Sports City project is to come up on 125 acres, but the Authority was yet to give them possession of 25 acres. The HC bench, in its April 3, 2023, order, asked the Authority to explain why it had invited bids for the project even before land was acquired. The HC also asked the Authority how it could propose action against the developer for failure to complete construction when the builder had not been allotted the entire land needed for the project.

The court also allowed the developer to proceed with the project in accordance with the building by-laws and the approved plans. The Authority was directed to specify the dues payable by the developer, as per the terms of the lease deed, and treat certain periods as ‘zero periods.’ On March 11, the developer’s counsel told the court that the Authority was yet to comply with the HC’s April order, even as govt was yet to give any clear reply.

Under the Sports City project, envisaged as an integrated mini township with all modern and world-class sports and other related facilities, land parcels on about 300 hectares of land were allotted at four places in the city. Residential and commercial land use was added as a sweetener to make the project lucrative for developers. Land parcels in Sectors 78, 79, and 101 and another in Sector 150 were allocated to Three C and Logix respectively.

One land parcel each in Sector 150 and Sector 152 were allotted to Lotus Greens and ATS Homes respectively. ATS Homes was selected as the lead developer to complete the international-level cricket stadium-cum-Sports City in Sector 152 in 2015 on about 125 acres of land.

As per the terms and conditions of the scheme, ATS formed a consortium of 10 companies, and the entire plot meant for the scheme was subdivided into 10 parts, and lease deeds were executed in favour of each of the 10 members of the consortium.
