TDR Allowed For Redevelopment Buildings On Internal Roads In Mumbai

Municipal Commissioner Iqbal Chahal has approved a proposal to allow Transfer of Development Rights (TDR) for redevelopment of old buildings that are on internal roads such as private layout roads, provided the road is minimum 9 metres in width and 50 metres from a public roads.

Most importantly a deed stating that the private access will be maintained in perpetuity will be required to be registered. The TDR will also be allowed even in the case of plots where the minimum width of the private layout road reduces at some length. Real Estate industry observers said that this will enable the redevelopment of several old buildings. 

However Chahal has deferred a decision on allowing TDR for landlocked plots, plots which are provided Right of Way through another plot. The approval was issued following a representation from the Practising Engineers, Architects and Town Planners Association.

To ensure smooth implementation the Building Proposal department of the BMC will record the width of all layout/ town planning or BMC Estate scheme roads as also Right of Way. The commencement certificate for any building on such roads will be issued on the condition that the road will be first developed to its full width and which will not be reduced in future, states the approval.
