RERA deadline ends; Six states yet to notify rules

The deadline of July 31 for registration of projects under the Real Estate (Regulation & Development) Act has ended. The ministry of housing and urban poverty alleviation (HUPA) notified 59 sections of the Real Estate (Regulation & Development) Act, 2016 on May 1 last year. All the states were supposed to notify real estate rules including the general rules and the agreement for sale rules and establish the real estate regulatory authorities and the appellate tribunals, maximum by April 30, 2017. However, most of the states either diluted the RERA rules or did not notify them. The government in April this year also notified the remaining 32 sections of RERA, which related to registration of ongoing projects that have not received completion certificate, registration of property agents, penalties for non-compliance, etc. The Act came to full force from May 1 this year, and real estate developers had time till July 31 to register their projects.

Out of a total of 35 states and union territories (UTs) in the country, excluding Jammu & Kashmir, 23 states and UTs have already notified their respective RERA rules, according to a government release. Six states are yet to notify the rules.

Six north-eastern states of Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland and Sikkim have some Constitutional issues relating to land belonging to community and autonomous councils and these are under examination.

States such as Goa, Himachal Pradesh, Kerala, Telangana, Tripura and West Bengal have formed draft rules, but haven't notified them. Uttar Pradesh, on the other hand, is planning to renotify RERA rules on the lines of the rules framed by the Centre.

A total 13 states and six UTs have formed interim regulators till now, while four states of Punjab, Maharashtra, Gujarat and Madhya Pradesh have formed permanent regulators. Among states which have notified RERA rules, just seven states have started the online project registration. According to RERA rules, states can set up their respective websites within one year from the establishment of authorities. However, states are allowed to take offline registration of projects till the website is not active.

Maharashtra has received the highest of around 3,700 applications for project registration and 3,800 applications for agent registrations as on Monday, according to a government notification. Gujarat has received around 110 applications for project registration and 80 applications for agent registrations so far, while Madhya Pradesh has received around 700 applications overall for registration including both projects and agents. Karnataka has received around 160 applications for project registration and 54 applications for agent registrations, while Rajasthan has received around 196 applications for project registration and 143 applications for agent registrations.
