Residents file police complaint against Ghaziabad builder

The residents of Gardenia Glamour-Phase I, Vasundhara Sector 3, on Saturday filed a police complaint against the builder for failing to pay up a compounding fee of Rs 20 crore to the UP Housing and Development Board for obtaining the completion certificate.

Residents file police complaint against Ghaziabad builder

The residents of Gardenia Glamour-Phase I, Vasundhara Sector 3, on Saturday filed a police complaint against the builder for failing to pay up a compounding fee of Rs 20 crore to the UP Housing and Development Board for obtaining the completion certificate.

However, the police are yet to register an FIR.

Paras Malik, chowki incharge of Vasundhara, who conducted an inquiry in the issue, said: “The builder has sought time till November 1 when they will meet the district magistrate to sort out the matter. The builder said they were ready to settle the monetary dispute with the housing board if the department gives them some relief. In case the builder do not solve their dispute with residents by November 2, an FIR will be lodged against them the very next day.”

The UP Housing and Development Board has already issued a notice to the residential society threatening to seal flats if the dues are not paid.

Around 24 flats were sealed in a different phase in this same society by the district administration two days ago for non-payment of the cost of the land on which the towers were built.

In their complaint, residents of Phase 1 alleged that they have been living in the housing society for the past six years after paying full amount of the 288 flats and other dues to the builders. Of the 288 flats in the society, 166 have been approved. However, the builder went on to build another 122 flats but have not paid the compounding fee for them.

“However, the builders, Sanjay Sharma and Manoj Kumar Ray, have neither fully completed the construction work, nor paid the compounding fee (for the extra flats) in the society, and despite our repeated reminders they failed to give any clarification in the matter. Moreover, they have not obtained the no objection certificate from the fire department,” the complaint further stated.

The housing board had issued its last warning on August 23 and threatened to seal the flats and take legal action if the builders did not deposit the compounding fee. “On October 12, the board ordered sealing of the society. Despite all this, the builders are neither interested in addressing our concern nor have they deposited the money,” said Shitanshu Raj Singh, vice president, Glamour Gardenia Apartment Owners’ Association Phase I.

Mahendra Prasad, joint housing commissioner (Meerut zone), said, “The builders are big defaulters of the department. They have cheated the investors and innocent buyers after taking the full amount from them."
