YEIDA to execute fresh lease deeds with third-party developers of 13 Sports City projects, following an Allahabad High Court.

Fresh Lease With Third-Party Developers For 13 Sports City Projects

The 13 projects involved 13,132 buyers across sectors 25 and 19. Executing the fresh deeds had become mandatory following the HC's decision, which nullified every reference to JAL in previous agreements. Apart from these lease deeds, a new tripartite agreement will be signed between the developers, homebuyers and YEIDA.

While cancelling the allotment of land and upholding the interest of third-party developers (sub-lessees), a division bench of Justices Manoj Kumar Gupta and Kshitij Shailendra has asked YEIDA to issue individual notices to the third-party developers within four weeks and complete all documentation in 12 weeks.

In the 13 projects, the Authority has identified 9,902 sanctioned flats and 3,230 residential plots. Its CEO Arun Vir Singh said developers could upload their documents on the Authority's portal by June 21, the same deadline that applies to homebuyers.

The developments in these 13 projects range from high-rise towers to villa plots. While Imperia Homes Planners has approvals for 629 flats in Sector 25, Royal Hometown Planners has 480 flats, of which 224 have been sold. Pyramid Townships' two parcels together make up 615 units. Gaur Sons' twin high-rise parcels in Sector 19 account for 3,104 units, followed by Solitaire Real Infra's tower cluster, which has 2,250 sanctioned flats. Gaur Sons' colony in Sector 19 has 3,230 plots, with 2,210 of them already sold. Presidency Infra Heights, MSA Developers, VGA Buildtech, Homes & Soul Infratech, and Imperia Structure add 2,824 more units between them.

The case began after YEIDA cancelled JAL's Sports City allotment on Feb 12, 2020, over mounting dues. JAL, which was allotted the land parcel in a special development zone (SDZ) in 2008, had promised an international sports, education, and healthcare hub anchored by the Buddh International Circuit. It launched 12 housing schemes on its own and sub-leased the additional land for 13 more projects by third-party developers.

JAL challenged the cancellation of land, and initially secured a stay order. But after multiple hearings, the HC upheld YEIDA's right to reclaim the land.

On March 10, the court asked YEIDA to complete JAL's 12 partially built housing projects with staggered deadlines — one year for projects 75% complete, 18 months for those at 50%, 30 months for 25% ready projects, and three years for the rest. A monitoring committee comprising govt officials, YEIDA executives, Rera representatives, and homebuyers' nominees will oversee the implementation.

While YEIDA was preparing to bring in a construction partner, an interim order by the Supreme Court last month — restraining the Authority from appointing new developers without its permission — has temporarily halted the process. The matter will be heard again on July 19.
