In a significant development, the Hon’ble Bombay High Court has granted a stay on the investigation in the FIR filed by its flat purchaser against the promoters of Keyana / Kalpataru Developers for their Goregaon project.
The stay order was issued by the Division Bench of the Hon’ble Bombay High Court on June 28, 2024. In its interim order, the Division Bench highlighted that the lower Court had not adequately considered the complexity of law while directing lodging of the FIR.
Senior Advocate Shirish Gupte representing the promoters, argued that the complainant had failed to adhere to the principles established by the Hon’ble Supreme Court in several landmark judgements. The Senior Advocate stressed that these precedents clearly outline the proper procedure for filing such complaints was not followed by the complainant while filing the complaint.
